Has any court ever ruled that a picture of you, taken in public, is a seizure or search? Seems quite the contrary, as surveillance footage is routinely used to identify suspects, track them, demonstrate they were at scenes, often without obtaining warrants as camera owners will turn the footage over on request. Prime example currently being FLOCK cameras, some are owned by private entities and they all share that data with others.
Courts have ruled that biometrics can be compelled to be used to unlock phones, not violating your fourth or fifth amendment rights. It's not far fetched to apply the same standard to a photo taken in public and used for this purpose.
