It would be a similar argument to the ones used for making Lolicon stuff illegal. If cartoon children are illegal then obviously the AI stuff that looks real would be, too.
That said, I don't know how this sort of case would pan out in the US. I'm not sure where it would fall under the previous supreme court rulings for the 1st Amendment. AI doesn't seem to be doing anything novel, but what it is doing is ratcheting things that already exist up to 100 - for better or for worse.
