It would never completely stop open source AI, but it would slow the open source development down significantly. These big AI companies just need their private models to be better than the open source alternatives. If open source development lags 3 to 10 years behind them at all times, then they are satisfied.
Once the development is forced to underground and no new research is published, it starts to seriously affect all open source development. To add to that, these AI companies want regulation on AI hardware. Hard to do AI research if you don't get any access to the big guns the companies are using.
It's all about keeping the bleeding edge.
