How do countries that ban gun ownership do it? Guns also aren't some highly specialized technology that requires specific hardware that you could restrict.
Just because you can't preemptively stop a crime doesn't make a law making it a crime useless. There's very probably many people who illegally own guns in such countries. But if they are ever used and it becomes public they can be held accountable. Same here. Yes, a company or individual can choose to set up their own face recognition system. But if it ever gets out they can be held responsible for it.
